By accessing or using Who's Up, you agree to these Terms of Use.

If you do not agree, do not use the platform.

2. Nature of Service

Who's Up provides a real-time event tracking platform for performances and competitions.

Information displayed on the platform is entered by event operators.

We do not independently verify event data.

3. No Guarantee of Accuracy

All information is provided “as is.”

Who's Up does not guarantee:

  • Accuracy of class results
  • Timeliness of updates
  • Completeness of listings
  • Continuous uptime

Users rely on displayed information at their own discretion.

4. Limitation of Liability

To the fullest extent permitted by law, Who's Up shall not be liable for:

  • Indirect or consequential damages
  • Loss of business or sponsorship revenue
  • Errors in posted results
  • Platform downtime
  • Operator input errors

Our total liability shall not exceed any fees paid by the event organizer for the use of the platform.

5. Indemnification

You agree to indemnify and hold harmless Who's Up, its owners, and operators from any claims, damages, or liabilities arising from:

  • Data submitted by event organizers
  • Unauthorized use of the platform
  • Uploaded logos or content that infringe third-party rights
  • Misuse of the service

Event organizers are solely responsible for the accuracy and legality of the content they submit.

6. Operator Accounts

Operators are responsible for:

  • Maintaining account security
  • Accuracy of event data
  • Proper use of the platform

We reserve the right to suspend accounts that misuse the service.

7. Intellectual Property

The Who's Up platform, branding, and software are protected intellectual property.

Users may not copy, reverse engineer, or commercially exploit the platform without written permission.

8. Governing Law

These Terms are governed by the laws of Ontario, Canada.
